Warranty Disclaimer / Limitation of Liability

WARRANTY FOR HARDWARE:

Peoplekey hardware products are warranted against faulty parts, manufacturing defects, premature component failure and bad workmanship for a period of twelve months from the date of shipping from Peoplekey / Biometric Systems International Pty Ltd. Peoplekey / Biometric Systems International’s will either replace or repair the failed or defective component(s) or will replace said equipment free of charge. The customer must bear all costs for freight and transport of the equipment back to Peoplekey / Biometric Systems International Pty. Peoplekey / Biometric Systems International Pty shall not be liable for consequential damages resulting or arising from equipment failure or any resulting data corruption.

WARRANTY FOR SOFTWARE:

There is absolutely no warranty for Peoplekey / Biometric Systems International Pty Ltd software products. Peoplekey Software products are provided to you, the customer, on an as is basis without any warranty what so ever. Peoplekey hereby disclaims all warranties, express and implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, use, accuracy, title or non-infringement. In addition, Peoplekey makes no, and hereby specifically disclaims any warranty, that the Software product will meet your requirements, or that your use of the Software product will be uninterrupted, timely, secure or error free; nor does Peoplekey make any warranty, and Peoplekey specifically disclaims all warranty, as to the results that may be obtained from the use of the Software product or that defects or errors in the Software product will be corrected. In no event shall Peoplekey be liable to you for direct, indirect, consequential, special, punitive or incidental damages or lost profits, whether foreseeable or unforeseeable, even if any representative of Peoplekey has been advised of the possibility of such damages (including, but not limited to, claims for loss of data, goodwill, use of money or use of Peoplekey products, interruption in use or availability of data, stoppage of other work or impairment or other assets), arising out of breach or failure of warranty or condition, breach of contract, misrepresentation, negligence, strict liability in tort, or otherwise.

WARRANTY FOR BIOMETRIC PERFORMANCE

Peoplekey cannot and will not warrant the biometric performance and matching capability for a given individual or small collection of individuals. Many factors regarding the performance of a biometric device or system are outside the technical capability of the product suite and include the likes of aptitude, intent, levels of training and the suitability of the biometric device for the outcome desired. In any biometric technology there will always be a small percentage of those individuals that have difficulties due to one or more of the following types of factors;

They are difficult to or cannot enrol, they have difficulty verifying or cannot use the product or they have no biometric suitable for use. Typically these scenarios are reflected in a small percentage of individuals.
